Filing Bankruptcy is a complex process and requires an understanding of legal procedures and financial laws.
Those who do not qualify for a Chapter 7 Bankruptcy due to income restrictions, may qualify for debt relief through a Chapter 13 Bankruptcy. Filing Chapter 13 will re-organize and consolidate debts. When filing a Chapter 13, a plan will be filed with the court to repay creditors allowing you to keep property. Chapter 13 is also used to stop home foreclosures and vehichle repossessions in situations where you are behind on payments, and allows you 36 to 60 months to repay the past due portion.

Means Test
The bankruptcy Means Test is a federal process that evaluates a person's ability to afford basic needs while filing for Chapter 7 bankruptcy. The test compares a person's income and expenses to the median costs for a household of similar size in their community. The goal is to determine if the person can repay their debts over time, rather than having the court discharge them. If you as an individual, or married couple, exceed the income limits, you maybe required to file for relief under Chapter 13, which is also a powerful tool for Debtors.
